These terms apply to your use of ProjectFashionista and all ProjectFashionista content independently of the delivery platform that you utilize. YOU AGREE THAT YOUR ONLY REMEDY ARISING OUT OF YOUR USE OF A PROJECTFASHIONISTA SUBSCRIPTION SERVICE IS LIMITED TO THE DIRECT DAMAGES YOU ACTUALLY INCUR ARISING OUT OF YOUR USE OF PROJECTFASHIONISTA OR OF THE PROJECTFASHIONISTA CONTENT SUBJECT TO A LIMIT EQUAL TO THE SUBSCRIPTION FEE THAT YOU PAID TO PROJECTFASHIONISTA PURSUANT TO THESE TERMS OF SERVICE DURING THE BILLING PERIOD IN WHICH THE DAMAGE OCCURRED.
The above disclaimers and restrictions on liability apply equally to your use of ProjectFashionista and all ProjectFashionista content.
By clicking "I Agree" during the registration form you are agreeing to indemnify, and hold harmless ProjectFashionista Data Corp., its affiliates, subsidiaries, directors, officers, agents, employees, content providers, partners and licensors from all claims, demands, liabilities, losses, costs and/or damages of any kind, including reasonable attorneys' fees, made by any third party due to or relating to your use of the website, including but not limited to content that you have made available in any way through the service, your breach of this Agreement, your connection to the Service, or your violation of any rights of another person.
WARNING: We strongly suggest that you exercise caution when reading and/or writing on the discussion forums. ProjectFashionista does not assume responsibility for any portion of any information posted on the discussion forums, nor are we responsible in any way for any commercial, trading or investment decisions that may result from information derived, directly or indirectly, from the discussion forums. We reserve the right to remove any content and/or terminate an account at our own discretion.
Your password is for your personal use only, and you agree to keep it secret and not to share it with anyone (except as expressly allowed under this Membership Agreement). YOU ARE RESPONSIBLE FOR ALL CHARGES THAT ACCRUE FROM ANY AND ALL USE OF YOUR PASSWORD, WHETHER YOU AUTHORIZED SUCH USE OR NOT. IN CASE OF UNAUTHORIZED USE OF YOUR PASSWORD YOU MUST PROMPTLY NOTIFY PROJECTFASHIONISTA IMMEDIATELY.
No software made available in connection with the ProjectFashionista service may be downloaded from the service, exported or re-exported in violation of U.S. export laws. The downloading and use of any software may is at your sole risk.
At its own sole discretion, ProjectFashionista may immediately terminate your ProjectFashionista account for any or no reason including any associated email addresses. You agree that ProjectFashionista shall not be liable to you or to any third party for the termination of your account and its access to the ProjectFashionista service. Your account will be close if you breach any term in this Agreement. It may also be cancelled at your request or if the service is discontinued. Your account will be terminated if you engage in fraudulent or illegal activities or at the request of law enforcement and/or government agencies. If your account is terminated, all of the content that you made available through the service may be removed.
This Agreement is governed by and construed in accordance with the laws of the United States and the State of Connecticut. To the extent possible in the applicable jurisdiction, the parties irrevocably agree that the courts of the State of Connecticut, United States has exclusive jurisdiction to settle any dispute which may arise in connection with these Terms of Service.
You may not assign, or otherwise transfer any of your rights under these Terms of Service. If any provision of these Terms of Service is found to be invalid by a court with jurisdiction, the remaining provisions of these Terms of Service shall remain in full force and effect. These Terms of Service were last updated December 27, 2005 and replace all previous Terms of Service for ProjectFashionista.
